High Court has remarked that what is the regulation under which the government should go and make a housing scheme.

Islamabad High Court Chief Justice Athar Minallah heard petitions against the construction of Pakistan Naval Farms and Navy Sailing Club. In 1981, the Navy’s lawyer submitted a notification to the federal government authorizing the Navy Foundation.

The court questioned the Navy lawyer as to whether the Bahria Foundation still exists. Lawyer Malik Qamar Afzal replied that G-Bahria Foundation is still working.

The Chief Justice of the High Court asked the Navy lawyer under which law Pakistan Navy can buy the land itself, how can your business do this business?

 Malik Qamar Afzal replied that not the Pakistan navy but a directorate and it is independent in its work and Bahria Farms was a project of Bahria Foundation.

Justice High Court Athar Minallah said that if they take a loan from someone and he defaults, will the case be against the naval chief? According to what you have read, this committee will be responsible for any mistake. The law is equal for all. No one is above the law. In this way, it includes the basic rights of citizens. Do you also run a travel agency? ? Is it still going on?

The Navy lawyer replied that it was through a joint venture. I do not have the details yet.

The court asked that the Bahria Foundation is a scheme, it is private, not of the Armed Forces.

The court remarked that the private investment of the Home Secretary and some officers cannot be termed as an investment of the Ministry of Home Affairs. If something goes to the Registrar High Court, it will be owned by the High Court. It belongs to the Navy, not just its directorate.

Chief Justice Athar Minallah asked the CDA officer what is the regulation under which the government can go and make a housing scheme, the CDA has destroyed the master plan of Islamabad, you have to be satisfied. How did you get this permission, where is it that any department in Zone Four can form a society?
